By inviting Belfry to your Discord server, accessing our website, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

You must be at least 13 years old (or 16 in the European Union) to use Belfry, in compliance with Discord's Terms of Service and applicable laws.

2. Description of Service

Belfry provides Discord event management services, including but not limited to:

• Event creation, scheduling, and management
• RSVP tracking and attendee management
• Giveaway creation and winner selection
• Guest pass system for external attendees
• Ticket generation and validation
• Waitlist management
• Event analytics and reporting
• Discord scheduled event synchronization
• Automated notifications and reminders
• Web dashboard for event management

3. User Accounts and Authentication

3.1 Discord OAuth2

Belfry uses Discord's OAuth2 for authentication. By logging in, you authorize us to access your Discord user information and guild list as specified in our Privacy Policy. You are responsible for maintaining the security of your Discord account.

3.2 Account Responsibilities

You agree to:

• Provide accurate information when using the Service
• Maintain the security of your Discord account
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account
• Not share your account credentials with others

4. Acceptable Use Policy

4.1 Permitted Use

You may use Belfry for:

• Managing legitimate community events
• Running fair and honest giveaways
• Organizing gaming sessions, tournaments, or meetups
• Educational or business events
• Community building activities

4.2 Prohibited Use

You agree NOT to:

• Violate Laws: Use the Service for any illegal activities or to promote illegal content
• Harassment: Use the Service to harass, abuse, threaten, or intimidate others
• Spam: Send unsolicited messages, advertisements, or spam through the Service
• Fraud: Run fraudulent giveaways, scams, or deceptive events
• Hate Speech: Create events or content promoting hate, violence, or discrimination
• Adult Content: Use the Service for NSFW events without proper age verification and Discord's guidelines
• Impersonation: Impersonate others or misrepresent your affiliation
• Bot Abuse: Attempt to exploit, hack, or reverse engineer the Bot
• API Abuse: Make excessive API requests, DDoS attacks, or attempt to overload our systems
• Data Scraping: Scrape, harvest, or collect user data without authorization
• Circumvention: Bypass rate limits, access controls, or security measures
• Malicious Code: Upload viruses, malware, or malicious code
• False Information: Provide false or misleading event information
• Gambling: Use giveaways for gambling or betting purposes
• Resale: Resell, redistribute, or sublicense the Service

5. Server Administrator Responsibilities

5.1 Permissions and Access

When you invite Belfry to your Discord server, you grant the Bot necessary permissions to function, including but not limited to: managing events, sending messages, managing roles, creating invites, and reading message history in configured channels.

5.2 Content Moderation

As a server administrator, you are responsible for:

• Ensuring events created in your server comply with these Terms
• Moderating event content and attendee behavior
• Complying with Discord's Terms of Service and Community Guidelines
• Ensuring giveaways are fair and comply with applicable laws
• Properly configuring guest pass and access control settings
• Respecting attendee privacy and data

5.3 Liability

You acknowledge that you, not Belfry, are responsible for the content and conduct in your Discord server. We are not liable for disputes, damages, or issues arising from events hosted in your server.

6. Giveaways and Contests

6.1 Legal Compliance

You are solely responsible for ensuring your giveaways comply with all applicable laws, including but not limited to sweepstakes regulations, tax laws, and consumer protection laws in your jurisdiction. Belfry provides tools but does not provide legal advice.

6.2 Fair Conduct

When running giveaways, you must:

• Clearly state rules, eligibility, and prizes
• Use Belfry's random selection feature fairly
• Honor all prizes and commitments
• Not manipulate results or favor specific users
• Comply with Discord's guidelines on giveaways
• Not require payment or purchase for entry (unless legally permitted)

6.3 No Liability

Belfry is not responsible for prize fulfillment, disputes between hosts and winners, or any legal issues arising from giveaways. We provide the platform; you are responsible for execution.

7. Intellectual Property

7.1 Our Rights

Belfry, including its code, design, features, branding, and documentation, is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

7.2 Your Content

You retain ownership of content you create (event descriptions, banners, custom messages, etc.). By using Belfry, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display your content solely to provide the Service.

7.3 Feedback

If you provide feedback, suggestions, or ideas, you grant us the right to use them without compensation or attribution.

8. Service Availability and Modifications

8.1 Uptime

We strive for 99.9% uptime but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, or technical issues.

8.2 Changes to Service

We reserve the right to modify, suspend, or discontinue any feature or the entire Service at any time without prior notice. We are not liable for any modifications or discontinuation.

8.3 Updates

We may update the Bot, API, or website to add features, fix bugs, or improve performance. Continued use after updates constitutes acceptance of changes.

9. Termination

9.1 By You

You may stop using Belfry at any time by removing the Bot from your server and revoking OAuth2 authorization. You may request data deletion as outlined in our Privacy Policy.

9.2 By Us

We reserve the right to suspend or terminate your access to Belfry immediately, without notice, if you:

• Violate these Terms or our Privacy Policy
• Engage in prohibited activities
• Abuse the Service or harm other users
• Violate Discord's Terms of Service
• Engage in illegal activities
• Fail to respond to our inquiries regarding violations

9.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may delete your data as outlined in our Privacy Policy. Sections of these Terms that by their nature should survive termination will survive (e.g., liability limitations, dispute resolution).

10. Disclaimers and Limitations of Liability

10.1 "AS IS" Service

BELFRY IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10.2 No Liability for User Content

We are not responsible for user-generated content, including events, giveaways, messages, or attendee behavior. You use the Service at your own risk.

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BELFRY AND ITS DEVELOPERS, OPERATORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED $100 USD OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (WHICHEVER IS GREATER). SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR EXCLUSIONS OF LIABILITY, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.

10.4 Third-Party Services

Belfry integrates with Discord and may link to third-party services. We are not responsible for the availability, content, or practices of third-party services. Your use of third-party services is governed by their terms and policies.

11. Indemnification

You agree to indemnify, defend, and hold harmless Belfry and its developers, operators, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any laws or third-party rights
• Content you create or share through the Service
• Events or giveaways you host
• Disputes with other users

12. Dispute Resolution

12.1 Informal Resolution

If you have a dispute with us, please contact us first at support@belfry-app.org to attempt informal resolution. We will work in good faith to resolve the issue.

12.2 Arbitration

If informal resolution fails, any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (or equivalent in your jurisdiction). Arbitration will be conducted in English.

12.3 Class Action Waiver

You agree to resolve disputes on an individual basis only. You waive any right to participate in class actions, class arbitrations, or representative actions.

12.4 Governing Law

14. DMCA and Copyright

If you believe content on Belfry infringes your copyright, please contact us at dmca@belfry-app.org with:

• Description of the copyrighted work
• Location of the infringing content (event ID, guild ID, etc.)
• Your contact information
• A statement of good faith belief
• A statement under penalty of perjury that the information is accurate
• Your physical or electronic signature

14.2 Repeat Infringers

We will terminate accounts of repeat copyright infringers in accordance with the Digital Millennium Copyright Act (DMCA).

15. Export Controls

You agree to comply with all applicable export and import laws and regulations. You may not use Belfry in countries subject to U.S. embargoes or sanctions.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Belfry regarding the Service and supersede all prior agreements and understandings.

18. Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.

19. Assignment

You may not assign or transfer these Terms or your rights under them without our written consent. We may assign these Terms to any affiliate or successor without restriction.

20. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting a notice in our Discord support server, updating the "Last Updated" date, or sending a notification through the Service. Your continued use after changes constitutes acceptance of the modified Terms.
